When should this form be used?

The certificate of compliance with binding disclosure required all individuals in the dissolution of marriage to provide the other party with specific documents and financial information. It is required that these documents are given either through mail or hand delivery to the other party between  a time frame of 45 days of service of the petition for dissolution of marriage or adscititious petition for changes on the respondent.

The guidelines of the mandatory disclosure applies to all original and additional dissolution of marriage cases, other than the cases that are a simplified dissolution of marriage and cases in which the respondent is apportioned by a constructive service and refuses to answer. This form should be used to serve the purpose of notifying the court and the other party that you have obeyed the mandatory disclosure rule. The documents that are listed in section 2 of this form should be provided by each party if the relief being desired is permanent disregarding whether it is a supplemental or initial proceeding. Out of all of the documents that are states in this form, the only document that is required to be filed with the court and sent to the other party is the financial affidavit; all of the other documents are required to be sent to the other party but not filed with the court.
                                                           
It is mandatory for this form to either be printed in black ink or typed. After the form has been completed, it is suggested to file the initial with the clerk of the circuit court in the county where the case is being filed. It is important that you keep a copy of this form for your own records. The copy of this form must then either be hand delivered or mailed to any other party that is involved in your case.
